With this declaration, THE MARKET PropCo Srl<\/strong>, owner of the San Marino Outlet and, as such, Data Controller, hereby informs the users and visitors to its premises that, upon passing specific signs posted at the entrance to the premises with brief informative declarations, they enter areas in which photographic and\/or audiovisual recordings may be made, for the purposes of producing advertising material and announcements to be made public by the Data Controller (or by third parties appointed for that purpose) for the reasons and in the manners described hereafter.
Personal data will only be used in accordance with:<\/p>\n\n\n\n

\u2022 Regulation no. 2016\/679 (hereafter \u201cRegulation\u201d);<\/p>\n\n\n\n

\u2022 Law no. 171\/2018 of the Republic of San Marino (hereafter \u201cLaw\u201d);<\/p>\n\n\n\n

\u2022 the guidelines of the authorities appointed as Guarantors.<\/p>\n\n\n\n

1. <\/strong>D<\/strong>ata Controller, <\/strong>DPO and <\/strong>office responsible for processing personal data<\/strong><\/p>\n\n\n\n

Pursuant to articles 13 and 14 of Law no. 171\/2018 and European Regulation no. 2016\/679, THE MARKET Srl<\/strong> (hereafter \u201cTHE MARKET\u201d), with registered office at no. 41 strada degli Angariari \u2013 47891 Falciano (RSM), C.O.E. 26567, in the person of its legal representative pro tempore, Email: privacy@themarket.sm<\/a>, as owner of San Marino Outlet<\/strong> (hereafter also simply \u00abOutlet\u00bb) and, consequently, data controller (hereafter \u00abdata controller\u00bb) is required to provide the following information.<\/p>\n\n\n\n

The Data Controller has appointed a DPO, who can be reached by e-mail at dpo@themarket.sm or by writing to the address of THE MARKET.<\/p>\n\n\n\n

The Representative in the European Union for the processing and use of personal data is the company Promos Development Srl, with registered office at Via San Zeno no. 173, 25124 \u2013 Brescia, fiscal code and V.A.T. No. 04444270989, in the person of its legal representative pro tempore, Email: rappresentanteUEsanmarinoutlet@gmail.com;<\/p>\n\n\n\n

The company responsible for processing personal data, in its role as business and marketing manager in charge of handling relations with the users of the Outlet, is Promos S.r.l. \u2014 fiscal code and V.A.T. no.: 03123920179\u2014 San Zeno, 173\u2014 25124 Brescia (BS), Phone: +39 030 2422862,- e-mail: privacy@promosgroup.it, with Stable Organization in San Marino in Falciano, Strada degli Angariari 41.<\/p>\n\n\n\n

The Data Processor also has its own DPO who can be reached at the email address dpo@promosgroup.it , at the telephone number +39 030 242 2862 or by writing to the company offices.<\/p>\n\n\n\n

2. <\/strong>Purposes and legal bases<\/strong><\/p>\n\n\n\n

The Data Controller will process the personal data collected (in the form of photographs, audio and video recordings) exclusively for the purposes connected with the production of advertising material and messages, also on the occasion of specific events or exhibitions organized at the San Marino Outlet<\/em> (in which case, please refer also to the relative specific information sheets). <\/p>\n\n\n\n

For those purposes, the personal data may be published on all the channels of communication accessed by the Data Controller, on social networks and video platforms, as well as outside the organization, for the publication of articles in magazines, including online publications.<\/p>\n\n\n\n

The legal basis for this use is the consent of the data subject, which is valid also for the purpose of permission to use the image, pursuant to art. 90 of law no. 8\/1991 and articles 96 and thereafter of law no. 633\/1941, expressed by accessing the area subject to such recordings. The areas in which recordings may be made, on the occasion of events at the San Marino Outlet<\/em>, will be identified with special signs. It should be noted that when recording any videos, efforts will be made to avoid focusing on children and, as far as possible, photographing generic scenes without focusing on faces and particular close-ups.<\/p>\n\n\n\n

3. <\/strong>Data subject to processing<\/strong><\/p>\n\n\n\n

The data will be processed for the purposes indicated above, which can be defined as: <\/p>\n\n\n\n

Identification data: pictures.<\/p>\n\n\n\n

4. <\/strong>Processing methods and term of data conservation<\/strong><\/p>\n\n\n\n

The data will be processed, also with the aid of electronic media, by specifically authorized personnel for the activities of advertising and communication by the San Marino Outlet<\/em>, for the above-mentioned purposes, with the application of adequate security measures and in respect of the principles of legitimacy, propriety, transparency, limitation of purposes and minimization.<\/p>\n\n\n\n

The photographs taken and\/or video recordings made will be used until the purposes for which they were acquired has been fulfilled, after which they will be deleted, compatibly with any online publication that may have been made of them.<\/p>\n\n\n\n

5. <\/strong>Recipients of personal data<\/strong><\/p>\n\n\n\n

With regard to the purposes indicated, the data may be transmitted to companies and\/or persons who provide services, even externally, on behalf of the data controller for the development, promotion and advertising of the event. The data may also be transmitted to partners engaged in the organization of events, also as sponsors (for the processing of data); photographs and audio-visual recordings may also be made public on institutional websites, brochures and other digital or paper publications, and on the data controller's social media networks.<\/p>\n\n\n\n

6. <\/strong>Transfers of data to other countries<\/strong><\/p>\n\n\n\n

Some of the personal data of users are shared with recipients that may be located outside of the Republic of San Marino and the European Economic Community (EEC). The Data Controller guarantees that any processing of personal data by these recipients is done in respect of the Law and Regulation and, in any case, with full application of adequate security. Indeed, such transfers are based on a decision of adequacy or on the Standard Contractual Clauses approved by the European Commission.<\/p>\n\n\n\n

7. <\/strong>Relevant rights and how to exercise them<\/strong><\/p>\n\n\n\n

The articles from 15 to 22 of European Regulation no. 2016\/679 grant data subject\u2019s specific rights that they may exercise. Art. 15 recognizes the right of data subjects to access their personal data and obtain copies of them. The right to obtain a copy of their data shall not infringe on the rights and freedoms of others. With the request of access, data subjects have the right to obtain from the data controller confirmation or denial of the fact that their data are being processed and to know the purposes and categories of data involved, the third parties to which they have been communicated and whether the data have been transferred to a country outside Europe with adequate guarantees. The data subjects also have the right to know for how long their personal data will be stored. With respect to their personal data, data subjects may request correction of incorrect data and completion of incomplete data, as well as deletion (right to oblivion) at the conditions indicated by art. 17 of the Regulation, and may request limitation of processing, portability of data, and may object to their use or revoke their consent. <\/p>\n\n\n\n

To exercise the above rights, it is necessary to contact one of the following parties:<\/p>\n\n\n\n

- the Data Controller at the email address privacy@themarket.sm or the DPO at the address dpo@themarket.sm, or by writing to the address of the registered office of THE MARKET;<\/p>\n\n\n\n

\u2014 the Representative in the European Union at the email address rappresentanteUEsanmarinoutlet@gmail.com  or by writing to the address of its registered office at Via San Zeno n. 173, 25124 \u2013 Brescia (BS).<\/p>\n\n\n\n

Before responding, it may be necessary to identify the data subjects by asking them to supply a copy of their identity document. The data controller will provide a written answer without undue delay and, in any case, no later than one month after receipt of the request.<\/p>\n\n\n\n

8. Claims with the Guarantor for the protection of personal data<\/strong><\/p>\n\n\n\n

Data subjects who believe that use of their personal data violates the provisions of the Law, the Regulation or, more in general, the norms on the subjects of the protection of personal data, may file a claim:<\/p>\n\n\n\n

\u2014 if they reside or work in the Republic of San Marino, or the violation occurs there, to the Guarantor for the Protection of Personal Data (www.garanteprivacy.sm), as provided by art. 66 of the Law, or to apply to the appropriate judicial authorities (art. 70 of the Law);<\/p>\n\n\n\n

\u2014 if they reside or work in the European Union, or the violation occurs there, to the Guarantor for the Protection of Personal Data  in the relative European country, as provided by art. 77 of the Regulation and, if in Italy, to the Italian Guarantor for the Protection of Personal data (www.gpdp.it) or to the appropriate judicial authorities (art. 79 of the Regulation).<\/p>\n","protected":false},"excerpt":{"rendered":"
